These Terms of Service explain the rules that apply when you browse our website, create an account, place an order, submit information or otherwise use Dropple’s products and services.

Throughout these Terms, the words “Dropple”, “we”, “us” and “our” refer to Dropple LLC.

By accessing or using our website or placing an order, you agree to these Terms and to the policies referred to within them.

If you do not agree to these Terms, you should not use our website or services.

Nothing in these Terms limits or excludes any mandatory consumer right, legal guarantee or remedy that cannot lawfully be limited or excluded.

Any promotional conditions, product-specific terms, quotation, order form or written agreement provided to you may also form part of the contract for the relevant order.

If a separate signed quotation or order agreement conflicts with these Terms, the signed agreement will take priority for that particular order, except where mandatory law requires otherwise.

3. Who may use our website

You must have the legal capacity to enter into a binding contract in your country of residence.

If you are under the age of legal majority in your country, you may only use the website or place an order with the involvement and permission of a parent or legal guardian.

You must not use our website or products for any unlawful purpose.

4. Accounts and customer information

You may be able to browse and purchase from our website without creating an account.

Where you create an account, you agree to provide current, complete and accurate information.

You are responsible for keeping your login details and password secure.

You should contact us promptly if you believe your account, email address or payment information has been used without permission.

We may suspend or restrict an account where we reasonably believe that:

  • The account is being used fraudulently.
  • Security has been compromised.
  • False information has been provided.
  • These Terms have been seriously breached.
  • Suspension is required by law.

We will act reasonably and will not remove any mandatory consumer right relating to an existing order.

Order-related emails are transactional and may be sent even where you have not agreed to receive marketing emails.

We may update, improve, replace or discontinue products.

Changes to future products or website information will not retrospectively alter an order already accepted, except where required by law, agreed with you or necessary to correct an obvious error where correction is legally permitted.

7. Product availability

All products are subject to availability.

Placing a product in your basket does not reserve it.

If a product becomes unavailable after you place an order, we may offer:

  • A partial refund
  • Cancellation and a full refund of the affected amount

We will not substitute a materially different product without your agreement.

8. Product use and care

Dropple products must be used, cleaned and stored in accordance with their intended purpose and any care instructions supplied.

You should regularly inspect:

  • Lid
  • Straw
  • Seals
  • Lanyard
  • Base
  • Other removable components

Stop using a product if a component is cracked, damaged, loose or appears unsafe.

Children should use Dropple products with appropriate adult supervision.

Dropple products should not be used in a way that creates an unreasonable safety risk.

9. Hydration information

Hydration information, blog content, tracking guidance and hydration-calculator results provided by Dropple are for general educational and informational purposes only.

They are not medical advice and are not intended to diagnose, treat, cure or prevent any medical condition.

Individual hydration needs vary according to factors such as:

  • Health
  • Climate
  • Physical activity
  • Pregnancy
  • Medication
  • Diet
  • Age

You should seek advice from a qualified healthcare professional where appropriate.

Do not consume excessive amounts of water based solely on a calculator or general online guidance.

10. Placing an order

When you submit an order, you are making an offer to purchase the selected products under these Terms.

Before submitting your order, you should check:

  • Product selection
  • Quantity
  • Personalisation
  • Delivery address
  • Contact details
  • Price
  • Currency
  • Delivery charge

An automated order-confirmation email confirms that we have received your order. It does not necessarily mean that the order has been accepted.

Unless applicable law requires otherwise, a binding sales contract is normally formed when we:

  • Confirm that the order has been accepted for fulfilment; or
  • Send a dispatch confirmation

11. Order acceptance and cancellation by Dropple

We may refuse, place on hold or cancel an order where:

  • The product is unavailable.
  • Payment is not authorised or is reversed.
  • Delivery is unavailable to the destination.
  • An obvious pricing or product-information error has occurred.
  • We reasonably suspect fraud, misuse or unlawful activity.
  • The order breaches these Terms.
  • The order breaches applicable law.
  • Necessary personalisation approval has not been provided.
  • The order contains content we cannot lawfully reproduce.

If we cancel an order after taking payment, we will refund the affected amount using the original payment method unless another lawful method is agreed with you.

We will not cancel an accepted consumer order arbitrarily.

12. Changes and cancellations requested by customers

Check your order carefully before submitting it.

Contact us through our Contact Us page immediately if you need to change or cancel an order.

Because order processing may begin quickly, we recommend contacting us within one hour of placing the order.

This one-hour recommendation does not remove any statutory cancellation or withdrawal right available under applicable law.

We cannot guarantee that changes or cancellation will be possible once:

  • Processing has begun.
  • The order has been dispatched.
  • Personalisation has started.
  • Engraving has started.
  • Custom production has begun.

13. Personalised, engraved and co-branded products

Where personalisation, engraving or co-branding is offered, you are responsible for checking:

  • Names
  • Spelling
  • Logos
  • Crests
  • Artwork
  • Colours
  • Quantities
  • Placement
  • Other customisation details

You confirm that you own, control or have permission to use any name, logo, crest, design, photograph, artwork or other material supplied to Dropple.

We may refuse wording or artwork that is:

  • Unlawful
  • Misleading
  • Discriminatory
  • Defamatory
  • Infringing
  • Offensive
  • Threatening
  • Otherwise inappropriate

Clearly personalised products may be excluded from change-of-mind cancellation or withdrawal rights where permitted by law.

This does not affect your rights where a personalised product is:

  • Faulty
  • Damaged
  • Incorrect
  • Not as described
  • Unsafe
  • Different from the approved artwork or order details

14. Bulk, school and business orders

Bulk, school, corporate, event and co-branding orders may be subject to a separate quotation or written order agreement.

That document may specify:

  • Pricing
  • Minimum order quantity
  • Artwork approval
  • Payment schedule
  • Production time
  • Delivery arrangements
  • Cancellation terms
  • Intellectual-property permissions

Where a separate written agreement applies, it will form part of the contract for that order.

Consumer protections may not apply in the same way where the customer is purchasing wholly or mainly for business purposes.

15. Prices and currencies

Prices may be displayed in:

  • AED
  • EUR
  • GBP
  • USD
  • Another supported currency

The displayed currency may depend on your location, market selection or website settings.

The final currency and amount payable to Dropple will be shown before you submit your order.

We may change future prices without notice.

A price change will not normally affect an order already accepted.

16. Pricing errors

We take reasonable care to ensure prices are accurate.

If an obvious pricing error affects an order, we may contact you and offer the option to:

  • Confirm the order at the correct price; or
  • Cancel the affected product for a refund

We will not rely on this section to unfairly alter an accepted contract.

17. Taxes, duties and other charges

Prices may include or exclude VAT, sales tax, customs duties and import charges depending on:

  • Destination
  • Fulfilment location
  • Local law
  • Checkout arrangement

Where taxes or duties are collected by Dropple during checkout, they will be included in the order total.

Where they are not collected during checkout, they may be payable by the recipient before or upon delivery.

Your bank, card issuer or payment provider may apply:

  • Currency-conversion charges
  • Foreign-transaction fees
  • Its own exchange rate

These third-party charges are outside Dropple’s control.

18. Payment

Available payment methods may include:

  • Visa
  • Mastercard
  • American Express
  • Apple Pay
  • Google Pay
  • Shop Pay
  • Other methods shown at checkout

Payments are processed through Shopify and approved payment providers.

Dropple does not store your complete card details.

You confirm that:

  • You are authorised to use the selected payment method.
  • The billing information provided is accurate.
  • Sufficient funds or credit are available.

Payment may be authorised or collected when the order is submitted, depending on the selected payment method and checkout configuration.

19. Promotions and discount codes

Promotions and discount codes may be subject to separate conditions displayed with the offer.

Unless stated otherwise:

  • Only one discount code may be used per order.
  • Codes cannot be exchanged for cash.
  • Codes may have an expiry date.
  • Codes may apply only to selected products or markets.
  • Codes may exclude shipping or personalised products.
  • Codes may not be applied retrospectively.
  • Codes may be withdrawn where issued or used in error.

We may refuse a discount where we reasonably believe it has been obtained or used fraudulently.

This does not affect an order already accepted where the discount was validly applied.

20. Shipping and delivery

We deliver to countries and regions made available through our website and checkout.

Shipping availability, cost and estimated delivery time depend on factors including:

  • Destination
  • Product quantity
  • Parcel weight
  • Parcel dimensions
  • Fulfilment location
  • Carrier availability
  • Customs requirements

Orders may be fulfilled from the United Arab Emirates, Ireland or another disclosed fulfilment location.

Estimated delivery times are not guaranteed unless we expressly agree to a guaranteed service or date.

21. Customs and import requirements

International orders may be subject to:

  • Import VAT
  • Customs duties
  • Clearance charges
  • Brokerage fees
  • Local taxes

Where these amounts are not collected during checkout, they may be payable by the recipient.

You are responsible for checking whether products may lawfully be imported into the destination.

Dropple will describe products and declare their value accurately.

We will not:

  • Mark commercial purchases as gifts.
  • Deliberately understate parcel value.
  • Provide false customs information.

22. Delivery address

You must provide a complete and accurate:

  • Delivery address
  • Postcode
  • Recipient name
  • Email address
  • Telephone number

Contact us immediately if you notice an error.

We will try to correct the address before dispatch but cannot guarantee changes after processing has begun.

Additional reshipping costs may apply where a parcel is returned because of incorrect information, where legally permitted.

23. Delivery, risk and ownership

Subject to applicable law, risk of loss or damage passes to you when you, or a person nominated by you other than the carrier, takes physical possession of the products.

For qualifying EU consumer orders, risk generally remains with the seller until the consumer or an authorised third party takes physical possession of the goods.

Ownership normally passes after:

  • Full payment has been received; and
  • The products have been delivered

This does not change any mandatory risk-transfer or consumer-protection rule.

24. Returns, withdrawal and refunds

Returns, cancellations, withdrawals and refunds are governed by our Returns & Refund Policy.

Where an eligible online order is delivered to an EU consumer, the consumer generally has 14 days after delivery to notify the trader of a decision to withdraw, subject to lawful exceptions. Those exceptions can include clearly personalised products and certain opened hygiene-sealed goods.

Change-of-mind rights are separate from rights concerning products that are faulty, damaged, unsafe, incorrect or not as described.

Nothing in these Terms reduces a mandatory withdrawal right.

25. Faulty, damaged or non-conforming products

Nothing in these Terms excludes any statutory right or remedy applying where a product is:

  • Faulty
  • Unsafe
  • Damaged
  • Incorrect
  • Not as described
  • Missing components
  • Not fit for its ordinary or agreed purpose

Depending on the applicable law and circumstances, remedies may include:

  • Repair
  • Replacement
  • Price reduction
  • Refund
  • Contract termination

UAE consumer-protection rules provide remedies concerning defective goods and prohibit agreements that unlawfully remove a consumer’s right to compensation.

EU rules require goods to conform to the contract and generally make the seller responsible for defects becoming apparent within at least two years of delivery. Available remedies can include repair, replacement, price reduction or termination, depending on the circumstances and national law.

26. Intellectual property

Unless otherwise stated, the following are owned by Dropple LLC or used under licence:

  • Product designs
  • Website layout
  • Software
  • Marketing materials

You may not reproduce, distribute, modify, publish, sell, license, scrape or commercially exploit this content without prior written permission, except where applicable law permits.

Dropple branding must not be used in a way that:

  • Creates confusion
  • Suggests unauthorised endorsement
  • Misrepresents an association with Dropple
  • Infringes our intellectual-property rights

27. Customer-provided intellectual property

Where you provide artwork, logos or other content for personalisation, you retain ownership of that content.

You grant Dropple a limited right to use the supplied content only as reasonably necessary to:

  • Prepare proofs
  • Manufacture the order
  • Communicate with you
  • Complete fulfilment
  • Keep necessary business records

We will not claim ownership of your organisation’s logo merely because it was supplied for engraving.

You are responsible for ensuring you have permission to provide the content to us.

28. Reviews, photographs and feedback

Where you voluntarily submit a review, photograph, video, comment or suggestion, you retain ownership of your original content.

You grant Dropple a non-exclusive, worldwide and royalty-free licence to display, reproduce and share that content for legitimate business and promotional purposes.

This may include use on:

  • Our website
  • Social media
  • Email marketing
  • Advertising
  • Retail or presentation materials

You confirm that submitted content:

  • Is accurate where presented as a genuine review.
  • Is based on genuine experience.
  • Does not infringe another person’s rights.
  • Does not disclose private information without permission.
  • Is not unlawful, defamatory or misleading.
  • Does not contain malware or spam.

We may correct formatting or obvious spelling errors, but we will not materially change the meaning of a genuine review.

You may contact us to ask that we stop using your content in future marketing. We will take reasonable steps to do so, although we may be unable to withdraw materials already printed, published or distributed.

29. Third-party links and services

Our store is hosted on Shopify Inc., which provides the ecommerce platform used to display and sell Dropple products.

Unless expressly stated otherwise, purchases made through this website are contracts between you and Dropple LLC.

Shopify is not the seller of Dropple products and is not responsible for Dropple’s:

  • Product descriptions
  • Fulfilment
  • Shipping
  • Returns
  • Customer support

Shopify or another provider may separately process payments or provide technical services under its own terms.

31. Privacy and personal information

Our collection and use of personal information is governed by our Privacy Policy.

That policy explains how we may collect, use, store, disclose and protect personal information.

By using the website, you acknowledge that internet transmissions cannot be guaranteed to be completely secure.

32. Prohibited uses

You must not use the website or our services:

  • For unlawful, fraudulent or deceptive purposes.
  • To infringe intellectual-property rights.
  • To violate privacy rights.
  • To upload malware or harmful code.
  • To attempt unauthorised access.

This section relates to website availability and does not remove statutory rights applying to purchased products.

34. Errors and inaccuracies

Subject to the above, Dropple is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the relevant contract was formed.

Where you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill.

Where you purchase products wholly for business purposes, Dropple will not be responsible for:

  • Loss of profit
  • Loss of business
  • Loss of revenue
  • Loss of opportunity
  • Loss of anticipated savings
  • Indirect commercial loss

Nothing in this section affects a mandatory right or remedy.

36. Events outside our reasonable control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including:

  • Natural disasters
  • Extreme weather
  • War
  • Civil unrest
  • Epidemics
  • Government action
  • Customs disruption
  • Strikes
  • Transport interruption
  • Carrier failure
  • Major telecommunications failure
  • Widespread technical outages

We will take reasonable steps to reduce the effects of any disruption.

This does not remove mandatory rights concerning delayed or undelivered orders.

37. Suspension or termination of website access

We may suspend or terminate access to the website where:

  • You seriously breach these Terms.
  • You engage in fraudulent activity.
  • Your use creates a security risk.
  • We are required to do so by law.

Termination of website access does not automatically cancel an accepted order or remove existing rights and obligations.

These Terms are generally governed by the laws of the United Arab Emirates.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protection provided by the laws of your country of habitual residence that cannot lawfully be excluded.

Nothing in these Terms prevents either party from relying on a mandatory jurisdiction or dispute-resolution right available under applicable law.

40. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue to apply.

41. Waiver

If we delay or fail to enforce a right, this does not mean that the right has been waived.

A waiver relating to one breach does not automatically apply to another breach.

42. Changes to these Terms
